CandysAI Terms and Conditions

These Terms and Conditions define the rules for using the CandysAI platform, available at https://candysai.com (“Website”), and related services (“Services”), provided by CandysAI, located at Polska ul. Aleja Wolności 2c 84-300 Lębork. The Services include interactions with virtual AI companions, including text conversations, image generation, videos, and voice recordings.

By using the Website and Services, you accept these Terms and Conditions. If you do not agree with their provisions, please stop using our platform.

1. Definitions

  • User: A natural person who is at least 18 years old and uses the Website or Services.
  • Account: An individual user account on the Website, allowing access to the Services.
  • AI Companion: A virtual character generated by artificial intelligence, with whom the User can interact.
  • Services: Functionalities offered by CandysAI, including conversations with AI companions, character creation, multimedia generation (images, videos, voice recordings), and other functions available on the Website.

2. Terms of Use

  • 2.1. Age: CandysAI Services are intended exclusively for adults (18+). By registering, you confirm that you are at least 18 years old.
  • 2.2. Account: To use the full functionality of the Services, you must create an Account, providing true data (e.g., email address, nickname). You are responsible for the confidentiality of login details and all activities on your Account.
  • 2.3. Equipment and Access: The User is responsible for providing their own equipment, software, and internet access necessary to use the Website.
  • 2.4. Legal Compliance: Use of the Services must comply with these Terms and Conditions, applicable law, and social norms.

3. Rules for Using the Services

  • 3.1. Permitted Use: You may use the Services to create and personalize AI companions, conduct conversations, generate multimedia, and for other purposes consistent with the platform’s functionality.
  • 3.2. Prohibited Actions: It is forbidden to:
    • Publish or generate illegal content, including pornographic, offensive, discriminatory, incitement to violence, or content that violates the rights of third parties.
    • Attempt to interfere with the operation of the Website (e.g., hacking, transmitting viruses).
    • Use the Services in a manner that infringes the rights of CandysAI or other users.
    • Share your Account with third parties or use other people’s Accounts.
  • 3.3. Content Moderation: CandysAI reserves the right to moderate user-generated content (e.g., messages, images) to ensure compliance with the Terms and Conditions. In case of violations, we may remove content, suspend, or block the Account.

4. Payments

  • 4.1. Subscriptions and Fees: Some Services are paid (e.g., access to advanced features, multimedia generation). Information on prices and subscription plans can be found on the Website https://candysai.com.
  • 4.2. Payment Operator: Payments are processed by PayPal. On bank statements, transactions will appear as “PayPal” or a similar designation (e.g., “PayPal Polska”), ensuring discretion. CandysAI does not store full payment card details.
  • 4.3. Refunds: Refunds are possible in accordance with the rules specified by law (e.g., 14-day right of withdrawal for consumers in the EU). Contact us at smentochadam[a]gmail.com to request a refund.
  • 4.4. Automatic Renewal: Subscriptions may be automatically renewed, about which you will be informed at the time of purchase. You can disable automatic renewal in your Account settings.

5. Intellectual Property Rights

  • 5.1. CandysAI Ownership: The Website, Services, software, AI algorithms, AI companion designs, and other content provided by CandysAI are protected by copyright and are the property of CandysAI or our licensors.
  • 5.2. User-Generated Content: You grant CandysAI a non-exclusive, royalty-free license to store, process, and use content generated by you (e.g., conversations, images) for the purpose of providing Services and improving the platform.
  • 5.3. Restrictions: You may not copy, modify, distribute, or reproduce CandysAI content without our consent, except as permitted by law.

6. Data Protection

How we process your personal data is described in our Privacy Policy. By using the Services, you consent to the processing of data in accordance with that policy.

7. Liability

  • 7.1. Service Availability: CandysAI makes every effort to ensure continuous availability of the Services, but we do not guarantee the absence of technical interruptions (e.g., due to maintenance or failures).
  • 7.2. Limitation of Liability: CandysAI is not responsible for damages resulting from:
    • Incorrect use of the Services by the User.
    • User-generated content that violates the Terms and Conditions.
    • Interruptions in access to the Website due to reasons beyond CandysAI’s control.
    • CandysAI’s maximum liability is limited to the amount paid for the Services.
  • 7.3. AI Content: AI companions generate responses based on algorithms, which may lead to unexpected or inaccurate content. CandysAI is not responsible for such content, unless it violates the law.

8. Termination of Agreement and Account Closure

  • 8.1. Account Closure by User: You can delete your Account at any time in the Website settings https://candysai.com. After deleting the Account, your data will be processed in accordance with the Privacy Policy.
  • 8.2. Suspension or Closure by CandysAI: We may suspend or close your Account in case of violation of the Terms and Conditions, e.g., publishing prohibited content or failing to make payments.
  • 8.3. Right of Withdrawal: If you are a consumer in the EU, you have the right to withdraw from the agreement within 14 days of its conclusion without giving any reason, unless you have started using the Services (e.g., generating content), which may limit this right.

9. Complaints

  • 9.1. Submitting Complaints: If you have comments about the Services, submit a complaint to smentochadam[a]gmail.com or Polska ul. Aleja Wolności 2c 84-300 Lębork. Describe the problem, providing details (e.g., order number, date).
  • 9.2. Resolution: We will process complaints within 14 days of receipt. We will inform you of the outcome in writing or by email.
  • 9.3. Consumer Rights: If you are a consumer, you can use out-of-court dispute resolution methods, such as mediation with the Consumer Ombudsman or the ODR platform (ec.europa.eu/consumers/odr).

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by Polish law. Any disputes will be resolved by the court competent for the registered office of CandysAI, unless consumer regulations state otherwise (e.g., the court competent for the consumer’s place of residence).
